Before You Lop: The Legal Checks Every Queenslander Should Do First

The lopper’s truck is booked for Saturday. The tree’s fate feels decided. But five minutes of checking first can be the difference between a tidy yard and a five-figure fine — Queensland takes unlawful clearing seriously, and “I didn’t know” is not a defence.

Run these five checks before a single cut.

Check 1 — Is the vegetation protected?

Search your address on your council’s interactive mapping (Development.i on the Sunshine Coast) and look for biodiversity, waterway or character overlays. Check for Vegetation Protection Orders and previous development conditions. On the Sunshine Coast many trees are protected; in Noosa, most clearing needs a permit unless exempt.

Check 2 — Whose tree is it, exactly?

Boundary trees belong to the land they grow from — not the fence line you assume. A trunk 200mm on the neighbour’s side makes it their tree. The Neighbourhood Disputes Act gives you rights over overhang, not ownership. When in doubt, get the boundary confirmed before anyone climbs.

Check 3 — Is anyone living in it?

Hollows, nests and dreys mean wildlife law joins the conversation. Queensland’s Nature Conservation Act protects breeding places; disturbing them can require a Species Management Program. A pre-work hollow check is fast, cheap and the right thing to do.

Check 4 — What’s the genuine hazard status?

Trees posing immediate risk to life or property can generally be made safe without waiting for approval — but document everything: photos, video, an arborist’s note. The exemption protects genuine emergencies, not convenient ones.

Check 5 — Who’s doing the cutting?

Your legal position is only as good as your operator. Insured, qualified arborists check these boxes professionally; uninsured cowboys leave the liability — and often the illegal cut — with you. Ask for certificates before Saturday.
